The board of directors of Brazil's National Electric Energy Agency (ANEEL) opened Public Consultation No. 007/2026, through which it proposes an exceptional regulatory mechanism for Transmission System Use Contracts (CUST) signed by generating plants.
Joining will be voluntary and will aim to revoke generation concessions and amicably terminate CUSTs, with a lower regulatory burden to free up access to the transmission system occupied by projects without concrete implementation viability.
The regulations provide for the revocation of generation concessions with the return of the corresponding performance bonds, where applicable; the exemption from any fine resulting from ongoing inspection processes; and the authorization for the National Electric System Operator (ONS) to terminate the CUST agreements signed with the generating plants, without applying termination charges.
ANEEL's technical area has detected a significant oversupply of licensed generation projects, which is generating relevant repercussions for third parties, especially with regard to access to the transmission system.
Suggestions can be sent to ANEEL by email to cp007_2026@aneel.gov.br from April 16 to 30.
In addition, more information can be found on the Public Consultations page of the ANEEL website.
New edition of the Electricity Transmission Licensing Plan 2025
While the public consultation is underway, the Ministry of Mines and Energy (MME) published the fourth edition of the Electricity Transmission Subsidy Plan (POTEE), which serves as the main guide for the expansion of the National Interconnected System (SIN), consolidating both the works that will be tendered and those that will be authorized. The state of Goiás is one of the protagonists of this edition, with initiatives focused especially on the Northeast region and on increasing the capacity for transformation.
Among the highlighted projects is the new Iaciara 2 substation (230/138 kV), which will operate in conjunction with the new Rio das Oguas Iaciara 2 transmission line (230 kV).
In addition to the new facilities, the plan includes a schedule for the replacement of transformers at the Itapaci (230/69 kV), Águas Lindas (230/69 kV), Xavantes (230/138 kV) and Goiânia Leste (230/13.8 kV) substations.
The strengthening of the state's infrastructure is completed with new improvements at the Serra da Mesa substation (230/138 kV).
In the southern region, the states of Rio Grande do Sul and Paraná stand out, as they are acquiring new transmission lines and substations to meet the growing demand from local distributors.
For the state of Rio Grande do Sul, the plan includes strategic works for the Panambi and Cruz Alta regions, based on studies by the Energy Research Company (EPE).
To mitigate overloads and ensure electrical safety in the medium and long term, the 230/138 kV Passo Real substation and the 69 kV Cruz Alta 1 Panambi C1 transmission line will be implemented.
The plan also includes reinforcements to other transmission facilities (DIT) at the Panambi 1 and Cruz Alta 1 substations.
In the state of Paraná, the focus is on the expansion of the Iguaçu substation (230/138 kV).
This project is a derivative of the Reliability Study for the Foz do Iguaçu Region and aims to adapt the transformation capacity to the projected load for the coming years.
The licensing agreements in the Southeast region will allow the connection of data centers to the National Interconnected System (SIN).
This measure seeks to guarantee the energy infrastructure necessary to support the growth of the data processing sector in the region.
